Terms of Service
Last updated October 15, 2026
Draft for legal review. This document describes how the service actually works, but it has not been reviewed by a lawyer. Bracketed items such as [Company legal name] and [Governing jurisdiction] must be filled in before launch.
These terms are an agreement between you and [Company legal name] ("we", "us"), which operates DM My Agent at dmmyagent.com (the "Service"). By listing an inbox, connecting an agent, or sending a paid message, you agree to them. If you use the Service for an organization, you confirm that you can bind it to these terms.
1. What the Service does
DM My Agent lets a person or team (a "Lister") publish a page where others (a "Sender") pay to send them a message. Messages pass through a relay that masks both parties' real email addresses. Listers usually manage their inbox through an AI agent connected over the Model Context Protocol (MCP), or at the owner review screen.
2. Accounts and verification
- You sign in by proving control of an email address with a one-time code. Keep your inbox and any API tokens secure; actions taken with them are treated as yours.
- A listing goes live only after the inbox it delivers to has been verified and payouts are connected.
- You must be at least 18, or the age of majority where you live, and able to form a binding contract.
- Handles are first come, first served among verified owners. We may reclaim a handle that impersonates someone, infringes a trademark, or is unused.
3. Paid messages and refunds
- Holds, not charges. When a Sender pays, their card is authorized for the listed price. Nothing is captured until the Lister replies.
- Reply or refund. If the Lister sends a qualifying reply within the listing's reply window (between 1 hour and 6 days, shown on the listing), the payment is captured. If the Lister declines, or the window passes without a qualifying reply, the authorization is released and the Sender is not charged.
- Qualifying reply. A reply sent through the relay or the Service's tools that meets the listing's minimum length (40 characters unless the Lister sets otherwise). Automatic replies do not qualify.
- No guarantee of content. Paying guarantees a reply or a release of the hold, not a particular answer, outcome, or tone. Once a payment is captured it is final, except where the law requires otherwise or we decide, at our discretion, to refund a reply that was abusive or clearly not a good-faith response.
- Card issuers set how long a released authorization takes to disappear from a statement; we can't speed this up.
4. Fees and payouts
- Listing is free. We keep a platform fee of 10% of each captured payment. Card processing costs are paid out of our fee. Senders pay the listed price with no added fee from us; their bank may charge its own fees, such as for currency conversion.
- Payouts are made by Stripe to the Lister's connected account under the Stripe Connected Account Agreement, which Listers accept during onboarding. Stripe may require identity verification and may delay or hold payouts.
- Listers are responsible for their own taxes on income received through the Service.
- We may change the fee with at least 30 days' notice to Listers. Changes do not affect payments already held.
5. Acceptable use
You may not use the Service to:
- harass, threaten, defraud, or impersonate anyone, or send spam, malware, or phishing;
- send content that is illegal, sexually exploits minors, or infringes others' rights;
- try to unmask a Lister's real address, or move a conversation off the relay to avoid fees;
- list an inbox you don't control, or create listings to squat on other people's names;
- probe, overload, or circumvent the Service's limits and security, or scrape it.
Messages are screened automatically for threats and illegal content, and those are held for the Lister's review instead of being delivered. Messages are not filtered for topic. We may block senders, pause listings, withhold fees on abusive activity, or close accounts that break these rules.
6. Your content
You keep ownership of the messages and attachments you send. You give us a limited license to store, process, scan, and deliver them as needed to run the Service, including automated triage. You are responsible for what you send and confirm you have the right to send it.
7. AI agents
If you connect an AI agent, it acts on your behalf with the permissions you grant. You are responsible for replies, declines, and listing changes it makes. Automated triage and suggested replies may be wrong; review anything important before relying on it.
8. Availability and changes
We aim to keep the Service available but don't promise it will be uninterrupted. We may change or discontinue features. If we shut the Service down, we will release outstanding holds and pay out captured funds owed to Listers.
9. Disclaimers and liability
THE SERVICE IS PROVIDED "AS IS". TO THE EXTENT THE LAW ALLOWS, WE DISCLAIM IMPLIED WARRANTIES, AND OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE FEES WE EARNED FROM YOU IN THE 12 MONTHS BEFORE THE CLAIM OR US$100. WE ARE NOT LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES, OR FOR WHAT OTHER USERS SAY OR DO. Nothing in these terms limits liability that cannot be limited by law, or rights you have as a consumer.
10. Termination
You can stop using the Service at any time by pausing or deleting your listings. Sections 4, 6, 9 and 11 survive termination.
11. Governing law and disputes
These terms are governed by the laws of [Governing jurisdiction]. Disputes will be resolved in the courts of [Venue], unless your local consumer law gives you the right to bring a claim where you live.
12. Contact
[Company legal name], [Registered address]. Email: [legal contact email]. We'll post changes to these terms on this page and, for material changes, notify Listers by email.
